Trademark registrations/renewals

Our experience trademark practitioners will start with clearing your proposed mark in Ukraine and evaluating its registerbility. Thereafter we provide you with our opinion letter summarizing our findings. If recommended we proceed with filing of the Trademark Application. We appreciate the time sensitivity and importance of the effective trademark protection and act promptly to develop individual protection strategy to ensure smooth prosecution and enforcement of your rights.

You will receive your search results complimented with our opinion letter within 5-10 business days following you corresponding request. If cleared, the trademark application will be filed the next business day following your confirmation.

Documents required for filing a Trademark Application in Ukraine

  1. Reproduction of the trademark;
  2. Name, country/state of incorporation, and address of the applicant;
  3. List of goods and/or services and respective International Classes (if known);
  4. Certified copy of the priority document (if Paris Convention Priority is claimed);
  5. Power of Attorney (no notarization or legalization is required).

We e-mail you quarterly updates on the status of the prosecution and respond to Office Action if any within 5 business days upon your approval of the suggested response or without your approval if you instruct us to do so. The estimated time for trademark examination is 12 to 18 months following the filing date of the application and depending on the Ukrainian PTO's workload. Please note, there is no opposition period stipulated by the Ukrainian Trademark Law. Once the trademark is allowed to registration it is registered automatically and the registration may be challenged only in court. There is no use requirement for registration purposes, however, we recommend that you start using the mark within 3 years upon registration, otherwise, the mark becomes vulnerable to cancellation by an interested party by the corresponding court action. The registration is valid until cancelled in court or abandoned by non-renewal. Following the registration we keep records of your trademark for renewal purposes. The mark should be renewed every ten years. No proof of use is required for renewal purposes.

When we confirm that your trademark registration has been renewed we provide you with the actual certificate of renewal with a translation of the pertinent details. Together with the certificate we include information pertaining to requirements under local law necessary to keep the registration in force and immune from attack. In addition, we place the renewal details on our proprietary computer records to enable us to inform you of the next renewal date. Certificates are carefully examined for accuracy by our staff, which is of particular importance as many are in foreign languages and/or foreign characters. When necessary we arrange to have the Trademark Office correct inaccurate or incomplete certificates, thereby ensuring that the owner's rights are correctly preserved.
